Terms of Service
These Terms of Service ("Terms") govern your access to and use of TomatoCloud's website, apps, account system, subscriptions, customer support, proxy, VPN, DNS, routing, and related network services (collectively, the "Service"). By creating an account, purchasing a subscription, installing an app, importing a subscription profile, or using the Service, you agree to these Terms.
1. Eligibility
You may use the Service only if you can enter into a binding agreement and are not prohibited from using the Service under applicable law. The Service is not intended for children under 13 or for anyone below the minimum age required by local law. If you use the Service for an organization, you represent that you are authorized to bind that organization to these Terms.
2. Accounts and Security
- You must provide accurate account information and keep your account email reachable.
- You are responsible for all activity under your account, subscription token, devices, credentials, and imported profiles.
- You must keep passwords, device bindings, API tokens, subscription URLs, and configuration links confidential.
- You must notify support promptly if you believe your account or subscription token has been compromised.
- We may refuse registration, suspend access, rotate credentials, or require additional verification when needed to protect the Service or other users.
3. Subscriptions, Plans, and Usage Limits
Access to paid features may require an active subscription or account balance. Plan details, traffic quotas, device limits, supported platforms, available nodes, speed characteristics, renewal rules, and feature availability may vary by product, region, promotion, and time.
- Usage is measured by our systems. Displayed usage may be delayed, rounded, or adjusted to correct technical errors.
- Unused traffic, time, balance, promotional credit, or trial access may expire according to the plan or promotion shown at purchase.
- You may not bypass device limits, traffic limits, rate limits, subscription checks, routing controls, or abuse-prevention systems.
- We may change node availability, routing, DNS behavior, protocols, or client configuration when needed for performance, security, compliance, or reliability.
4. Payments, Renewals, and Refunds
Prices, currencies, fees, taxes, discounts, and available payment methods are shown during checkout where applicable. Payment providers may process your payment information directly under their own terms and privacy practices.
- You are responsible for reviewing the selected plan, price, billing period, and renewal status before paying.
- Subscriptions may renew automatically only where the product flow states that auto-renewal applies.
- Refund eligibility depends on the checkout terms, payment channel rules, consumer protection laws, and whether the Service has been used.
- Chargebacks, payment disputes, suspected fraud, or unpaid balances may result in suspension or termination of access.
5. Acceptable Use
You must use the Service responsibly and lawfully. You may not use, encourage, or assist others in using the Service for any activity that is illegal, harmful, abusive, or disruptive.
- Do not attack, scan, overload, disrupt, or attempt unauthorized access to networks, devices, accounts, or services.
- Do not send spam, phishing, malware, bot traffic, credential-stuffing traffic, scraping abuse, or fraudulent traffic.
- Do not infringe intellectual property, privacy, publicity, contractual, or other rights of any person or organization.
- Do not use the Service to distribute illegal content, exploitative content, threats, harassment, or instructions for wrongdoing.
- Do not resell, sublicense, share, lease, proxy, relay, or commercially redistribute the Service without written permission.
- Do not reverse engineer, tamper with, modify, automate, or bypass app, subscription, billing, device, or security controls.
6. Network Service Rules
The Service is a network connectivity tool. Network paths, DNS answers, IP-family selection, routing policies, latency, throughput, packet loss, and node availability can change based on location, ISP conditions, congestion, local device state, maintenance, third-party providers, and destination behavior.
- We do not guarantee that any specific website, app, game, protocol, region, IP address, domain, or streaming catalog will be reachable.
- We may block or rate-limit traffic that threatens reliability, violates these Terms, or creates legal, security, or operational risk.
- You are responsible for destination accounts, third-party terms, regional restrictions, and any consequences of using third-party services.
- Some features may require local permissions such as VPN profiles, TUN interfaces, DNS settings, background services, notifications, or system proxy settings.
7. Apps, Configuration, and Updates
We may provide apps, installers, configuration profiles, subscription files, diagnostic tools, and update mechanisms. You must obtain them only from official channels or trusted links provided by us.
- You are responsible for keeping your app, operating system, browser, and security software reasonably up to date.
- We may change, deprecate, disable, or replace app features, protocols, nodes, or configuration formats.
- Diagnostics, speed tests, node tests, and health indicators are estimates and may not predict every real connection outcome.
- You must not distribute modified clients or configuration files that misrepresent their source or bypass account controls.
8. Service Availability and Changes
We aim to operate a reliable service, but uninterrupted access is not guaranteed. The Service may be affected by maintenance, upgrades, capacity limits, provider outages, abuse mitigation, lawful requests, routing changes, payment-provider issues, app-store policies, domain or certificate changes, or events outside our reasonable control.
We may modify, suspend, limit, or discontinue any part of the Service when reasonably necessary. When practical, we may provide notice through the website, app, account page, email, or support channel.
9. Suspension and Termination
We may suspend or terminate access, remove devices, rotate subscription tokens, restrict traffic, refuse support, or close accounts if we believe that you violated these Terms, created risk for the Service or third parties, abused payment systems, provided false information, or used the Service in a way that may expose us or others to legal, security, or operational harm.
You may stop using the Service at any time. Account deletion or cancellation requests can be submitted through the support channel shown in the app, website, or account page. Certain records may be retained as described in our Privacy Policy or as required for legal, tax, accounting, payment, security, or anti-abuse purposes.
10. Privacy

11. Intellectual Property
The Service, including apps, websites, interfaces, logos, text, software, configuration systems, routing logic, documentation, and other materials, is owned by us or our licensors and is protected by applicable intellectual property laws. These Terms do not transfer ownership of any intellectual property to you.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your own lawful personal or internal business purposes.
12. Third-Party Services
The Service may rely on or link to third-party services, including hosting providers, network operators, payment processors, app stores, operating-system vendors, email providers, customer support tools, and destination websites or apps. We are not responsible for third-party services, content, policies, availability, or decisions.
13. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service will be uninterrupted, error-free, secure, anonymous, compatible with every device, or available for every destination, protocol, or use case.
14. Limitation of Liability
To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunity, or connectivity, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total liability for any claim relating to the Service will not exceed the amount you paid to us for the Service during the three months before the event giving rise to the claim.
15. Indemnity
You agree to defend, indemnify, and hold harmless TomatoCloud, its operators, service providers, personnel, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your violation of these Terms, your violation of law, your content or traffic, or your infringement of third-party rights.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and may provide additional notice through the website, app, account page, email, or other appropriate channels. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
17. Governing Terms and Disputes
These Terms are governed by applicable law, excluding conflict-of-law rules, unless mandatory consumer protection laws in your jurisdiction require otherwise. If a dispute cannot be resolved through support, the dispute will be handled by the competent courts or dispute-resolution forum available under applicable law.
