Terms of Service

These Terms of Service ("Terms") govern your access to and use of TomatoCloud's website, apps, account system, subscriptions, customer support, proxy, VPN, DNS, routing, and related network services (collectively, the "Service"). By creating an account, purchasing a subscription, installing an app, importing a subscription profile, or using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service. You are responsible for making sure your use of the Service is lawful in the country or region where you are located and in any country or region where your traffic is sent, received, or processed.

1. Eligibility

You may use the Service only if you can enter into a binding agreement and are not prohibited from using the Service under applicable law. The Service is not intended for children under 13 or for anyone below the minimum age required by local law. If you use the Service for an organization, you represent that you are authorized to bind that organization to these Terms.

Access to paid features may require an active subscription or account balance. Plan details, traffic quotas, device limits, supported platforms, available nodes, speed characteristics, renewal rules, and feature availability may vary by product, region, promotion, and time.

4. Payments, Renewals, and Refunds

Prices, currencies, fees, taxes, discounts, and available payment methods are shown during checkout where applicable. Payment providers may process your payment information directly under their own terms and privacy practices.

5. Acceptable Use

You must use the Service responsibly and lawfully. You may not use, encourage, or assist others in using the Service for any activity that is illegal, harmful, abusive, or disruptive.

6. Network Service Rules

The Service is a network connectivity tool. Network paths, DNS answers, IP-family selection, routing policies, latency, throughput, packet loss, and node availability can change based on location, ISP conditions, congestion, local device state, maintenance, third-party providers, and destination behavior.

7. Apps, Configuration, and Updates

We may provide apps, installers, configuration profiles, subscription files, diagnostic tools, and update mechanisms. You must obtain them only from official channels or trusted links provided by us.

8. Service Availability and Changes

We aim to operate a reliable service, but uninterrupted access is not guaranteed. The Service may be affected by maintenance, upgrades, capacity limits, provider outages, abuse mitigation, lawful requests, routing changes, payment-provider issues, app-store policies, domain or certificate changes, or events outside our reasonable control.

We may modify, suspend, limit, or discontinue any part of the Service when reasonably necessary. When practical, we may provide notice through the website, app, account page, email, or support channel.

9. Suspension and Termination

We may suspend or terminate access, remove devices, rotate subscription tokens, restrict traffic, refuse support, or close accounts if we believe that you violated these Terms, created risk for the Service or third parties, abused payment systems, provided false information, or used the Service in a way that may expose us or others to legal, security, or operational harm.

You may stop using the Service at any time. Account deletion or cancellation requests can be submitted through the support channel shown in the app, website, or account page. Certain records may be retained as described in our Privacy Policy or as required for legal, tax, accounting, payment, security, or anti-abuse purposes.

11. Intellectual Property

The Service, including apps, websites, interfaces, logos, text, software, configuration systems, routing logic, documentation, and other materials, is owned by us or our licensors and is protected by applicable intellectual property laws. These Terms do not transfer ownership of any intellectual property to you.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your own lawful personal or internal business purposes.

The Service may rely on or link to third-party services, including hosting providers, network operators, payment processors, app stores, operating-system vendors, email providers, customer support tools, and destination websites or apps. We are not responsible for third-party services, content, policies, availability, or decisions.

13. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service will be uninterrupted, error-free, secure, anonymous, compatible with every device, or available for every destination, protocol, or use case.

14. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunity, or connectivity, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total liability for any claim relating to the Service will not exceed the amount you paid to us for the Service during the three months before the event giving rise to the claim.

15. Indemnity

You agree to defend, indemnify, and hold harmless TomatoCloud, its operators, service providers, personnel, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your violation of these Terms, your violation of law, your content or traffic, or your infringement of third-party rights.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and may provide additional notice through the website, app, account page, email, or other appropriate channels. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.

17. Governing Terms and Disputes

These Terms are governed by applicable law, excluding conflict-of-law rules, unless mandatory consumer protection laws in your jurisdiction require otherwise. If a dispute cannot be resolved through support, the dispute will be handled by the competent courts or dispute-resolution forum available under applicable law.
